Terms of Service

The terms that govern use of AsciiThis.

Effective date: May 3, 2026. These Terms of Service apply to your access to and use of the AsciiThis website, app, public gallery, and API, including paid subscriptions, credit purchases, uploads, generations, and exports.

1. Acceptance of Terms

By accessing or using AsciiThis, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and Accounts

You must be at least 16 years old to use AsciiThis. If you are under 18, you may only use the service with permission from a parent or legal guardian, and they are responsible for your use of the service.

You must be at least 18 years old, or otherwise legally able to make the purchase, to buy subscriptions, credits, or other paid features.

You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.

You must provide accurate information and keep it reasonably current. We may suspend or terminate accounts that are fraudulent, unsafe, or in violation of these terms.

3. Permitted Use and Restrictions

You may use AsciiThis for lawful creative, personal, editorial, and commercial purposes, subject to these terms.

  • You may not use the service to violate law, infringe intellectual property or privacy rights, distribute malware, interfere with the service, or bypass rate limits, security controls, or payment requirements.
  • You may not probe, scrape, overload, reverse engineer, or automate the service in a way that materially harms service stability or other users.
  • You may not upload, generate, publish, or share content that you do not have the right to use.

4. Content and Safety Rules

You may not upload, generate, publish, export, or use AsciiThis to create or distribute content that:

  • sexually exploits or endangers children;
  • contains non-consensual intimate imagery;
  • unlawfully harasses, threatens, defames, or doxxes another person;
  • infringes copyright, trademarks, privacy, publicity, or other rights;
  • impersonates others in a misleading or harmful way;
  • promotes terrorism, extremist violence, or serious physical harm;
  • distributes malware, phishing, credential theft, spam, or fraud;
  • attempts to bypass moderation, rate limits, payment, or security controls; or
  • is otherwise illegal or creates legal, safety, or operational risk for AsciiThis.

We may remove, restrict, unpublish, or disable access to content at our discretion if we believe it may violate these terms, law, third-party rights, or platform safety rules.

5. User Content and Public Gallery

You retain ownership of content you upload or create, subject to rights needed for us to operate the service. You grant AsciiThis a non-exclusive, worldwide license to host, store, reproduce, process, modify, transmit, and display your content as necessary to provide, secure, improve, and support the service.

If you choose to publish an asset publicly, you also grant AsciiThis the right to display, distribute, and promote that public asset within the product, public gallery, search previews, and product marketing connected to the service. This licence continues while the asset remains public.

If you unpublish or delete a public asset, we will stop displaying it in the public gallery within a reasonable time, but previous shares, cached pages, search previews, marketing materials already produced, backups, or third-party copies may persist. Public assets may be indexed by search engines, AI crawlers, social platforms, and other third parties.

You represent that you have all rights, permissions, and consents needed for the content you upload, generate, publish, or export.

6. Generated Output and Exports

As between you and AsciiThis, and to the extent permitted by applicable law, you may use, publish, and commercially exploit outputs generated through the service, subject to these terms.

We do not guarantee that generated outputs are unique, copyrightable, non-infringing, or suitable for any particular use.

AsciiThis provides tools that transform inputs and generate outputs, including AI-assisted outputs. Because these systems are probabilistic and may depend on third-party model providers, outputs may be inaccurate, incomplete, unexpected, or similar to content generated for other users.

You are responsible for reviewing generated output before use or publication and for determining whether the output is appropriate for your project.

7. Paid Plans, Credits, and Billing

Some features require payment, subscription, or credits. Prices, included limits, credit allowances, and plan details are described on the pricing page and may change prospectively.

If you are a consumer, nothing in these terms affects your statutory rights. Where required by law, you may have cancellation rights. For instant digital content, generations, downloads, exports, API usage, or consumed credits, you agree that supply may begin immediately and acknowledge that you may lose cancellation rights for content or services already supplied or consumed.

You can cancel a subscription from your account page or by contacting us. Cancellation stops future renewals but does not automatically refund amounts already charged unless required by law or stated on the pricing page.

Subscriptions automatically renew unless cancelled before the next billing cycle. Credit packs and one-time purchases are charged when purchased. Except where required by law, fees are generally non-refundable once charged, supplied, delivered, or consumed.

You authorize AsciiThis and its payment processor to charge your selected payment method for subscriptions, renewals, taxes, and applicable one-time purchases. We may suspend paid features for failed payments, chargebacks, or suspected fraud.

Credits are not money, stored value, or a banked balance. Credits are non-transferable, have no cash value, and may only be used for eligible AsciiThis features. Subscription credits, rollover rules, and any expiry terms are described on the pricing page or at purchase. We may revoke credits obtained through fraud, abuse, chargeback, exploit, or platform error.

8. API Access

If you use the API, you are responsible for all requests made with your API keys and for keeping keys secure. Rate limits, usage caps, and operational restrictions apply. We may rotate, revoke, or suspend API access to protect the service or enforce these terms.

9. Third-Party Services

The service may depend on third-party providers, including hosting, payment, analytics, email, storage, content delivery, and AI or model providers. We are not responsible for third-party services, outages, changes, or terms, except where required by law.

10. Intellectual Property and Complaints

AsciiThis, including the software, interface, branding, documentation, and site content other than user content, is owned by AsciiThis or its licensors and protected by intellectual property laws. These terms do not grant you any ownership rights in the service itself.

If you believe content on AsciiThis infringes your intellectual property rights, privacy rights, or other legal rights, contact us at notifications@asciithis.com with enough information to identify the content, explain your claim, and verify that you are authorised to act. We may remove or restrict access to content while we review a complaint.

11. Service Availability, Storage, and Changes

Generation, conversion, export, and API features may be delayed, fail, produce unexpected results, or be unavailable due to model providers, infrastructure, queue limits, maintenance, abuse controls, or technical issues.

AsciiThis is not intended to be your sole backup or long-term storage service. You are responsible for downloading and backing up any assets you want to keep.

We may change, limit, throttle, suspend, or discontinue features where needed to operate the service, manage capacity, respond to provider changes, improve safety, or comply with law.

12. Suspension and Termination

We may suspend, restrict, cancel, discontinue, or terminate access to all or part of the service, your account, your subscription, or particular features at any time, with or without notice, where we consider it necessary or appropriate for security, safety, fraud prevention, abuse, legal compliance, payment failure, third-party provider changes, business, operational, reputational, or technical reasons, or for breach of these terms.

We may also stop offering the service, a plan, a subscription, a feature, or a region at any time. Where reasonably practicable, we will try to give notice.

If we terminate a paid subscription or paid service for our convenience and not because of your breach, fraud, chargeback, abuse, illegal conduct, or legal necessity, we will refund any unused prepaid subscription period on a pro rata basis and any unused paid, unexpired credits or other prepaid balance that we decide should fairly be returned. We do not promise refunds for free allowances, promotional credits, consumed usage, or amounts already used, supplied, or earned.

You may stop using the service at any time.

13. Disclaimers

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights you have under consumer protection law.

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. We exclude all implied representations, warranties, conditions, and guarantees to the fullest extent permitted by law.

We do not guarantee uninterrupted availability, error-free operation, complete security, or that outputs will be unique, available, accurate, lawful for your intended use, non-infringing, merchantable, fit for a particular purpose, or suitable for any commercial, editorial, technical, or legal use case.

You use the service, outputs, exports, public gallery, API, and third-party integrations at your own risk. You are responsible for reviewing outputs, checking rights clearance, and deciding whether to use, publish, sell, distribute, or rely on any content.

14. Limitation of Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to the above, to the maximum extent permitted by law, AsciiThis and its suppliers, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, business, contracts, goodwill, reputation, data, use, opportunity, or anticipated benefits arising from or related to the service.

Subject to the above, our total aggregate liability for all claims arising out of or relating to the service, whether in contract, tort including negligence, breach of statutory duty, misrepresentation, restitution, or otherwise, will not exceed the greater of GBP 100 or the amount you paid to AsciiThis in the 12 months before the event giving rise to the claim.

15. Responsibility for Losses and Indemnity

If you are a business user, you agree to indemnify AsciiThis against claims, liabilities, damages, losses, and reasonable expenses arising from your content, your breach of these terms, your unlawful use of the service, or your violation of another party's rights.

If you are a consumer, you are responsible for losses we suffer that are a foreseeable result of your breach of these terms, unlawful conduct, or infringement of another party's rights.

16. Changes to the Service or Terms

We may modify, suspend, or discontinue features at any time. We may also update these terms. Updated terms become effective when posted unless a later effective date is stated. Continued use after the effective date means you accept the updated terms.

17. Governing Law and Disputes

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except where mandatory consumer protection law gives you the right to bring a claim elsewhere.
